TAPIN TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") form a binding legal agreement between you and TapIN Ventures, LLC ("TapIN," "we," "us," or "our") governing your access to and use of the TapIN mobile application and related services (collectively, the "Services").
By creating an account, or by downloading, installing, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Services.
We may update these Terms from time to time as described in the "Changes to These Terms" section below. Your continued use of the Services after a revised version takes effect constitutes acceptance of the changes.
2. ELIGIBILITY
The Services are intended exclusively for individuals who are 18 years of age or older. By using the Services, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.
You further represent that you are not barred from using the Services under the laws of the United States or any other applicable jurisdiction, and that all information you provide during registration is truthful, current, and accurate.
3. ACCOUNT REGISTRATION & SECURITY
Creating an Account
To use most features of the Services, you must register for an account and verify your mobile phone number by entering a one-time passcode we send by text message. You are responsible for providing accurate registration information and for keeping it up to date.
Username, Password, and Sign-In
You may optionally set a username and password so that you can sign back into your account from any device. You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@tapin.fun if you suspect unauthorized access to your account.
Two-Factor Authentication
When you sign in with a username and password, we may send a one-time text-message code as an additional verification step ("Two-Factor Authentication" or "2FA"). 2FA is enabled by default when you create your account. You may disable or re-enable it at any time from Profile → Login & Security. See the "Mobile Messaging Terms" section below for details on consent, message frequency, and how to opt out.
One Account Per Person
You may maintain only one TapIN account. You may not create an account on behalf of another person, impersonate any person or entity, or misrepresent your identity, age, or affiliation with any person or entity.
4. MOBILE MESSAGING TERMS
By providing your mobile phone number and using the Services, you agree to receive the text messages ("SMS") described below. This program is a condition of using certain account-security features of the Services and is separate from any marketing communications, which we do not send by SMS.
Program Description
We operate two categories of automated SMS messages sent to you as an account holder: (1) a one-time passcode sent when you register, used to confirm you control the phone number on your account; and (2) if you enable Two-Factor Authentication, a one-time passcode sent each time you sign in with your username and password. Neither category includes promotional or marketing content.
Consent and How to Opt Out
Registering for an account constitutes your consent to receive the phone-verification message described above; this message is required to create an account and cannot be turned off. Enabling Two-Factor Authentication constitutes your separate consent to receive a sign-in code by text each time you use your username and password; you may withdraw this consent at any time, free of charge, from Profile → Login & Security within the app, which immediately stops future 2FA text messages to your number.
Message Frequency, Rates, and Support
Message frequency varies based on your own activity — you will receive a text only when you register or when you sign in with 2FA enabled. Message and data rates may apply, depending on your mobile carrier and plan. For help, contact support@tapin.fun. Carriers are not liable for delayed or undelivered messages.
Supported Carriers
Our SMS program is supported by major U.S. wireless carriers. Carrier coverage is not guaranteed, and message delivery may be delayed or unavailable in some circumstances outside our control.
Related Privacy Terms
Our Privacy Policy describes in additional detail how we handle phone numbers and SMS opt-in data, including that this information is never shared with third parties for marketing or promotional purposes. See the "SMS & Two-Factor Authentication" section of our Privacy Policy.
5. THE SERVICES
TapIN is a proximity-based social platform that helps verified users discover and connect with people nearby for in-person meetups, through features including TapIN posts, TapIN History, public and private Pods, in-app messaging, and Trust Scores.
We may add, change, suspend, or discontinue any feature of the Services at any time, with or without notice. We do not guarantee that the Services will be available at all times or free from interruption, error, or delay.
6. USER CONDUCT
You agree to use the Services in accordance with our Community Guidelines, which are incorporated into these Terms by reference and available within the app. Without limiting those Guidelines, you agree not to:
- Harass, threaten, stalk, or harm any other user, on or off the Platform
- Provide false information during registration or verification, or impersonate any person or entity
- Use the Services for any unlawful purpose, or to solicit, promote, or facilitate illegal activity
- Post content that is obscene, defamatory, discriminatory, or infringes another's intellectual property or privacy rights
- Use automated means (bots, scrapers, or similar tools) to access or interact with the Services
- Attempt to circumvent our Trust & Safety systems, verification processes, or rate limits
- Send unsolicited commercial messages or spam to other users
- Reverse-engineer, decompile, or attempt to extract the source code of the Services, except where applicable law permits
Enforcement
We may investigate suspected violations of these Terms or our Community Guidelines and take any action we deem appropriate, including issuing warnings, removing content, restricting features, suspending, or permanently terminating your account, with or without prior notice, in our reasonable discretion.
7. USER CONTENT & LICENSE
You retain ownership of the content you post, upload, or otherwise submit through the Services ("User Content"). By submitting User Content, you grant TapIN a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that User Content solely for the purpose of operating, providing, and improving the Services.
You represent and warrant that you own or have the necessary rights to your User Content, and that it does not violate the rights of any third party or any applicable law.
We may, but are not obligated to, remove any User Content at our discretion, including User Content that we believe violates these Terms, our Community Guidelines, or applicable law.
8. TRUST & SAFETY DISCLAIMER
TapIN provides tools intended to support safer in-person meetups — including phone verification, Trust Scores, optional student verification, Verified Meetup Zones, and live-location safety features — but these tools are aids, not guarantees.
TapIN does not conduct criminal background checks on users and does not independently verify the identity, intentions, or trustworthiness of any user beyond the verification steps described in these Terms and our Privacy Policy. We do not guarantee the accuracy of any Trust Score, badge, or other indicator displayed on the Platform.
You are solely responsible for your own safety and decisions when interacting with other users, on or off the Platform, including whether, where, and how to meet another user in person. We strongly encourage you to use the Platform's safety features (such as Verified Meetup Zones and Live Location Sharing) and to exercise the same caution you would with any person you meet through the internet. TapIN is not responsible or liable for the conduct, whether online or offline, of any user of the Services.
9. THIRD-PARTY SERVICES
The Services may link to or integrate with third-party services, such as mapping applications. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
10. INTELLECTUAL PROPERTY
The Services, including their software, design, graphics, logos, and trademarks (excluding User Content), are owned by TapIN or our licensors and are protected by intellectual property laws. Except for the limited license to use the app as intended, no rights are granted to you in our intellectual property.
11. TERMINATION
You may stop using the Services at any time and may permanently delete your account from within the app (Profile → Delete Account) or, if you are unable to sign in, by contacting privacy@tapin.fun. In-app deletion takes effect immediately and is irreversible; the Privacy Policy describes what is removed and the limited placeholder information ("Deleted Account") that remains in other users' messages and meetup records. We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms.
Provisions of these Terms that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
12. DISCLAIMERS
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE PLATFORM, INCLUDING USER PROFILES, TRUST SCORES, OR VERIFICATION BADGES, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ON OR OFF THE PLATFORM.
13. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, TAPIN AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TapIN and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.
15. DISPUTE RESOLUTION & ARBITRATION
Please read this section carefully — it affects your legal rights and requires most disputes to be resolved through individual, binding arbitration rather than in court.
Agreement to Arbitrate
You and TapIN agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court.
Class Action Waiver
YOU AND TAPIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Opting Out
You may opt out of this arbitration agreement by sending written notice to legal@tapin.fun within 30 days of first accepting these Terms. Your notice must include your name, the email or phone number associated with your account, and a clear statement that you wish to opt out of arbitration.
16. GOVERNING LAW
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles, except to the extent governed by the Federal Arbitration Act with respect to the arbitration provisions above.
17. CHANGES TO THESE TERMS
We may revise these Terms from time to time. When we do, we will update the "Effective Date" below. For material changes, we will provide advance notice through the app or other reasonably effective means at least 14 days before the changes take effect. Your continued use of the Services after that date constitutes acceptance of the revised Terms.
18. MISCELLANEOUS
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and TapIN regarding the Services. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
